Higher Light Wellness LLC
Client Bill of Rights, Informed Consent, Liability Waiver & Notice of Privacy Practices


This document explains the nature of services offered by Higher Light Wellness LLC and your rights and responsibilities as a client. Please read carefully, acknowledge and sign before participating in any session.

1. Client Bill of Rights
As a client of Higher Light Wellness LLC, you have the right to:

  • Be treated with dignity, respect, and compassion


  • Receive services in a trauma-informed and supportive environment


  • Ask questions about the services offered


  • Decline any technique or request modification at any time


  • Stop a session at any time for any reason


  • Receive clear information about the nature and limitations of services


  • Have your personal information treated with reasonable privacy and discretion

Participation in services is voluntary.

2. Description of Services
Higher Light Wellness LLC provides trauma-informed energy healing services, including Usui Reiki, The Emotion Code and other energy-based modalities intended to support relaxation, stress reduction, emotional and energetic balance, and overall well-being.
Energy healing practices may involve:

  • light touch on or above the body for in-person sessions, guided by your comfort and consent


  • work within the energetic field surrounding the body


  • utilize crystals, magnets, and other tools to release trapped emotions


  • guided relaxation or grounding practices

Clients may experience sensations such as warmth, relaxation, emotional release, or energetic shifts. Experiences vary widely between individuals.
No specific outcome can be guaranteed. All services are provided “as is” without warranties of any kind, express or implied.

3. Scope and Limitations of Services
Services provided by Higher Light Wellness LLC are non-medical wellness services.
The practitioner:

  •  

  • is not a licensed physician


  • is not a licensed psychologist, therapist, or counselor


  • does not diagnose illness


  • does not prescribe medication
• does not treat or cure medical or mental health conditions

Energy healing is intended to support general wellness and relaxation and is not a substitute for professional medical or mental health care.
Clients are encouraged to consult licensed healthcare providers regarding medical or psychological concerns.

4. Voluntary Participation & Assumption of Risk
By participating in services, you acknowledge that:

  • participation is voluntary


  • experiences and results vary


  • emotional or physical responses may occur


  • you are responsible for communicating discomfort during a session

You assume responsibility for your own health decisions and well-being.

5. Touch Consent
Certain services may involve light, non-invasive touch or hands positioned just above the body as part of the Reiki practice.
By signing this document, you acknowledge that:

  • touch is intended to support relaxation and energy flow


  • touch will always be respectful and professional


  • you may request that the practitioner avoid touch entirely or modify techniques at any point during a session.


6. Release of Liability
To the fullest extent permitted by law, you voluntarily release and hold harmless Higher Light Wellness LLC and its owner, employees, contractors, and representatives from any claims, liabilities, damages, or losses arising out of or related to participation in services.
This includes claims relating to:

  • emotional responses


  • physical sensations


  • perceived energetic effects


  • perceived lack of results


  • reliance on information shared during sessions

This release applies to claims based on ordinary negligence but does not apply where prohibited by law in cases of gross negligence or intentional misconduct. I understand that by using Higher Light Wellness LLC services, I release Higher Light Wellness LLC from any claims, demands, or causes of action that may arise now or in the future relating to my participation in healing services.

7. Limitation of Liability
To the fullest extent permitted by law, the total liability of Higher Light Wellness LLC for any claim related to services shall not exceed the amount paid by the client for services received within the previous thirty (30) days.
Higher Light Wellness LLC shall not be liable for indirect, incidental, consequential, or special damages.

8. Indemnification Agreement
You agree to indemnify, defend, and hold harmless Higher Light Wellness LLC and its owner, employees, and representatives from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising from:

  • your participation in services


  • your misuse or misrepresentation of services


  • actions taken by you following a session


  • claims made by third parties alleging harm resulting from your actions or statements

This includes, but is not limited to, situations where action may be taken based on personal insights, guidance, or experiences from the sessions.

9. Privacy Practices & Confidentiality

Higher Light Wellness LLC respects your privacy and treats personal information with professional discretion. Information collected may include:
• name, contact information and date of birth


• intake information voluntarily provided


• notes from your sessions necessary to provide safe and personalized energy healing


• appointment history


This information is used only for purposes of:
• supporting safe, personalized energy healing services


• communicating about appointments


• maintaining business records required by law or for professional integrity


Higher Light Wellness LLC is a non-medical wellness provider and is not a HIPAA-covered healthcare entity, but reasonable safeguards are used to protect client information. All electronic and paper records are stored securely to protect your privacy.


Consent from a parent or legal guardian is required for services provided to minors, in accordance with New York State General Obligations Law § 3-503.
 
Although Reiki is not a licensed healthcare service, Higher Light Wellness voluntarily follows HIPAA confidentiality standards (45 CFR §164.502) and protects your data in accordance with New York State Civil Rights Law § 50-a. All shared information is private and securely maintained.

Personal information will not be shared without your explicit permission in writing, and may be disclosed only when required by law, including:
• court order or subpoena


• imminent risk of harm to self or others


• suspected abuse or neglect as required by law

10. Photo / Media Consent 
From time to time, Higher Light Wellness LLC may request permission to photograph or record testimonials for educational or promotional purposes. Consent may be withdrawn in writing at any time.

11. Payment & Refund Policy
All payments are due at the time of booking unless otherwise agreed in writing. Appointments are reserved exclusively for you. Cancellation require 24 hours’ notice.
Due to the energetic and time-based nature of services:

  • Missed appointments or cancellations of less than 1-hour in advance are non-refundable.

  • Late cancellations of less than 24 hours and up to 1-hour before scheduled session incur a 50% fee.

  • Late arrivals will conclude at the originally scheduled time. 

  • Exceptions may be made in emergencies.

  • Session Packages are transferable but non-refundable.

  • No guarantees of refunds unless required by law.


12. Website Use
You agree not to:

  • Copy or reproduce website content without permission

  • Use the website for unlawful purposes

  • Attempt to interfere with website security

  • All content on this website is the intellectual property of Higher Light Wellness LLC.


13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
Any disputes shall be resolved in courts located within New York State.

14. Severability
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

15. Acceptance of Terms

  • Using this website

  • Booking a session

  • Submitting payment

  • Participating in services

You acknowledge that you have read, understood, and agree to be legally bound by this Legal Notice, including the Release of Liability and Indemnification provisions.

16. Health Disclosure
I affirm that I will disclose any relevant physical or mental health conditions that may impact my session, and have been informed that magnets may be used.

17. Your Rights
You have the right to receive trauma-informed, respectful, and professional energy healing services, take responsibility for your own health and well-being and assume all risks associated with energy healing; decline or stop a session at any time; review information collected about you; request corrections or updates to your information; ask questions about how your information is used; expect a safe, calm, and supportive environment for all sessions.

18. Dispute Resolution & Arbitration
Any dispute arising out of services provided by Higher Light Wellness LLC shall first be addressed through good-faith efforts to resolve the matter informally. If a dispute cannot be resolved informally, the parties agree that the matter shall be resolved through binding arbitration in the State of New York, in accordance with applicable arbitration rules. Each party shall bear its own legal costs unless otherwise required by law.

19. Acknowledgment & Consent
By signing below (or selecting the acknowledgment checkbox for online bookings), you confirm that:

  • you have read and understood this document
